6. Payment Terms and Ordering

By placing an order through meal-pizzaluce.rest, you agree to pay all charges associated with your order, including the price of food items, applicable taxes, delivery fees, service fees, and any applicable gratuity. All prices are listed in United States Dollars (USD).

6.1 Payment Methods

We accept major credit cards, debit cards, and other payment methods as indicated at the time of checkout. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method and authorize Pizza Luce to charge your selected payment method for the total amount of your order.

6.2 Order Accuracy

You are responsible for reviewing your order before submission. Pizza Luce is not responsible for errors in orders as submitted by you. If you believe an error has occurred in your order, you must contact us as soon as possible using the contact information provided in Section 14 of these Terms.

6.3 Pricing and Availability

Pizza Luce reserves the right to change menu prices at any time without prior notice. In the event of a pricing error on the Site, Pizza Luce reserves the right to cancel any orders placed at the incorrect price and will notify you promptly. Menu items are subject to availability, and we reserve the right to substitute items of equal or greater value in the event that a specific item is unavailable.

6.4 Cancellations and Refunds

Due to the perishable nature of food products, all sales are generally final once an order has been submitted and confirmed. Cancellations may only be accommodated if the order has not yet been prepared. Refund requests for unsatisfactory food quality or order errors must be made within twenty-four (24) hours of the order being received. Pizza Luce reserves the right to issue refunds in the form of account credit, replacement orders, or original payment method refunds at its sole discretion.

6.5 Promotional Offers

Promotional codes, discounts, and special offers are subject to specific terms and conditions communicated at the time of the promotion. Promotions cannot be combined unless explicitly stated. Pizza Luce reserves the right to modify or terminate any promotion at any time without prior notice.


7. Delivery Terms

Delivery services are available within specified geographic areas and are subject to change. Estimated delivery times are approximations only and are not guaranteed. Factors including but not limited to weather conditions, high order volume, and traffic may affect delivery times. Pizza Luce and its delivery partners are not liable for delays beyond their reasonable control.

You are responsible for providing a complete and accurate delivery address. Pizza Luce is not responsible for failed deliveries due to incorrect address information provided by you. If a delivery cannot be completed due to circumstances within your control, you may not be entitled to a refund.


8. Disclaimers and "As-Is" Basis

THE SITE AND ALL SERVICES, CONTENT, AND PRODUCTS PROVIDED THROUGH MEAL-PIZZALUCE.REST ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZA LUCE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF TITLE OR NON-INFRINGEMENT
  • WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • WARRANTIES AS TO THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT ON THE SITE

PIZZA LUCE DOES NOT WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PIZZA LUCE OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

NUTRITIONAL INFORMATION PROVIDED ON THE SITE IS APPROXIMATE AND PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY. PIZZA LUCE MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY OF NUTRITIONAL OR ALLERGEN INFORMATION. CUSTOMERS WITH DIETARY CONCERNS OR FOOD ALLERGIES SHOULD CONTACT OUR STAFF DIRECTLY PRIOR TO ORDERING.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, IN NO EVENT SHALL PIZZA LUCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of goodwill or business opportunities
  • Personal injury or property damage related to your use of the Site
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the Site
  • Any other matter relating to the Site or our services

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF PIZZA LUCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, PIZZA LUCE'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.


10. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Luce and its respective officers, directors, employees, shareholders, agents, licensors, contractors, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your access to or use of the Site or our services
  • Your violation of any provision of these Terms of Service
  • Your violation of any applicable federal, state, or local law or regulation
  • Your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right

12. Dispute Resolution

THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

12.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, or where irreparable harm may occur.


13. Term and Termination
